Not having an estate plan in place at the time of your death gives the state of California control over how your assets will be distributed upon your death. Further, if you do not have an estate plan, your estate will be required to enter Probate.  Probate is a court procedure that oversees the transfer of assets in a person’s estate after death.  Probate is an expensive and time consuming process. A typical Probate takes 9 months to 2 years or more.  For an estate worth $1,000,000 the cost of Probate will be $23,000. For larger estates, the cost of Probate is even greater. 

An estate plan avoids the Probate process by placing the distribution of the estate outside the court system which can save a family time and money.
